Disclaimer

1. Definitions

“Sonepar” means Sonepar SAS, a French société par actions simplifiée, having its registered office at 25 rue d’Astorg, 75008 Paris, France, and registered with the registry of commerce in Paris under the number B 585 580 202 as well as its subsidiaries and branch offices.
 
“Client” means the customer, whether a company or an individual, purchasing the products from Sonepar, for its own personal use or for use/resell to customers in a professional context.
 
“Supplier” means the company manufacturing and/or selling the products to Sonepar.

PRODUCT CARBON FOOTPRINT” means the indication of the environmental profile of a product consisting in an indicator, based, exclusively, on an  inference of the CO2-eq emissions attaching to such this product derived:(i) either from data provided by a Supplier through a Supplier carbon data or Supplier Environmental Product Declaration whether externally verified by a third party or not, or (ii) depending on data available, from a series of relevant variables originating from several Supplier Environmental Product Declarations, Supplier carbon data and Supplier product technical characteristics whether verified by a third party or not, or (iii) from other relevant and reputable environmental declarations, norms, or standards.
 
“A PRODUCT CARBON FOOTPRINT INDICATOR” constitutes an order of magnitude of the CO2-eq footprint of a product. It does not represent a precise individual measure of the CO2-eq footprint of that product and does not allow to compare similar products within the same ETIM class or sub-class. Unless otherwise specified, a PRODUCT CARBON FOOTPRINT INDICATOR covers the entire life cycle of a product including extraction of raw materials, manufacturing, assembly, use and end-of-life, transport upstream and downstream of that product.
 
“CO2-eq” is a standard measure of one kilogram of CO2 equivalent (CO2-eq). It provides a common scale based on carbon dioxide (CO2) for measuring the climate effects on global warming of the different greenhouse gas emissions released in the atmosphere (carbon dioxide, methane, etc.).
 
“Energy usage” refers to the stage in the product's life cycle where it is used by the end user. This phase accounts for energy consumption, maintenance, and emissions associated with the use of the product.
 
“End-of-life” refers to the final stage of a product's life cycle, dealing with how it is managed after its useful life ends.
 
“ETIM class”  refers to classes part of the ETIM (ElectroTechnical Information Model) classification model, which is used to standardize the grouping and specification of technical products. Each ETIM class groups similar products and includes specific features that describe the technical characteristics of those products. Classes may also be divided into sub-classes.
 
“Life Cycle Assessment” or “LCA” measures the environmental impact of a product over its entire life cycle. In an LCA, the entire life cycle of a product is factored in and divided into different phases. From the extraction of raw materials (cradle) through manufacturing, assembly, and (re)use to waste processing (grave).
 
“Life Cycle Phase” refers to a given phase in the life cycle of a product as determined based on the ISO 14040 and 14044 standards.
 
“Transport Upstream” refers to and covers the various transportation operations involved in moving a finished product from the last supplier location to the local  Sonepar distribution center.
 
“Transport Downstream” refers to and covers the various transportation operations involved in moving a finished product from the local Sonepar distribution center to the customer or end-user premises.

 

2. Exclusions

Sonepar may not be held liable:
·    for any direct or indirect damage, including but not limited to lost profits, lost income, lost clients, or lost data that may, inter alia, result from the use of, from claims based on, or from the reliance by the Client on the PRODUCT CARBON FOOTPRINT;
 
·    for CO2-eq related data accessible by the Client through third-party links, including on any material or media made available or displayed by third parties, and in any event on sources displayed on the Sonepar Website, or made otherwise public by Sonepar;
 
·    for the contents of the information provided by Sonepar relating to among others the composition of the products analyzed, or to the evaluations, characteristics, scoring, analyses, recommendations, or opinions related to such products;
 
·    for the indicator attached to a product and based on the PRODUCT CARBON FOOTPRINT methodology used by Sonepar;
 
·    for any comparison made between products based on PRODUCT CARBON FOOTPRINT indicators obtained on the basis of the PRODUCT CARBON FOOTPRINT methodology;
 
·    for any comparison made between indicators obtained by products based on the PRODUCT CARBON FOOTPRINT methodology and indicators obtained by the same products based on the IMPACT TRACKER;
 
·    for any product placement and visibility expressly or impliedly resulting from the PRODUCT CARBON FOOTPRINT indicator.

 

3. No guarantee by Sonepar regarding the underlying data relied upon 

The Supplier and Client acknowledge that Sonepar shall not be held liable for any CO2-equivalent (CO2-eq) data provided by the Supplier related to the analyzed products, nor for the accuracy or completeness of such data.
 
Supplier and Client specifically acknowledge that Sonepar may not be held liable for any information regarding the compliance, reliability, and/or quality of the products, determined by or inferred from the standards, labels and/or norms affixed to such products.  The compliance with such standards, labels and/or norms is conducted by certification bodies that are independent of Sonepar.
 
Supplier and Client recognize also that Sonepar may neither be held liable for the accuracy of the information referred to above nor for the conformity of the products to the standards, labels and/or norms referred to above.

 

4. Indicative method based on CO-eq only – Not a comprehensive environmental profile

Supplier and Client acknowledge that the indicator obtained for a product is based solely on its CO2-eq emissions which are computed, estimated, or modelized based on the ETIM class or sub-class to which it belongs. This indicator is established by Sonepar subject to the scope and limitations of the PRODUCT CARBON FOOTPRINT methodology. 

Supplier and Client further acknowledge that the indicator obtained for a product on such basis may not be understood, interpreted, or relied upon as a comprehensive environmental profile for such product as the environmental profile of a given product may be influenced or impacted by other criteria not considered in the PRODUCT CARBON FOOTPRINT methodology. 

 

5. PRODUCT CARBON FOOTPRINT for indicative purposes only 

The Client expressly agrees that the PRODUCT CARBON FOOTPRINT provided by Sonepar is for indicative purposes only and serves solely as an estimate of the product’s CO2-eq footprint.
 
The Client and/or its final customer therefore rely on the PRODUCT CARBON FOOTPRINT at their own risk and under their own responsibility.
 
Sonepar does not guarantee the accuracy, completeness, or exhaustiveness of the information and/or data used in establishing the score obtained by a product based on the PRODUCT CARBON FOOTPRINT methodology.
 
Client expressly acknowledges that the database and information listed on the Sonepar Website are subject to change, particularly when products are added and/or removed by Sonepar.

 

6. PRODUCT CARBON FOOTPRINT not a purchase or use recommendation by Sonepar 

The Client and/or its final customer, are responsible for their choice to purchase and/or use a product based on their own criteria.
 
Sonepar shall not be held liable for any encouragement or discouragement of the purchase of a product by the Client and/or its final customer based on the display of the PRODUCT CARBON FOOTPRINT on the Sonepar Website.
 
The display of the PRODUCT CARBON FOOTPRINT on the Sonepar Website does not constitute a recommendation or guaranty of fitness for use of the featured products.
 
The Client and/or its final customer agree that the PRODUCT CARBON FOOTPRINT is not a substitute for consulting with an environmental authority or professional prior to purchasing and/or using a product from Sonepar.
